We are a limited company registered in England and Wales under company number 08568342, with our registered office and main trading address at Suite 2, Alexander House, Durham, County Durham, DH7 8XL. We are registered for VAT under number 250859686.

We amend these terms from time to time, so please check them each time you use the site. Our site is made available free of charge, and we do not guarantee that it or its content will always be available or uninterrupted. We may update, change, suspend or withdraw all or part of it at any time for business or operational reasons.

By using our site you accept these terms

By using our site to find a vehicle, obtain finance quotes or make an application, you confirm that you accept these terms and agree to comply with them. They apply to the exclusion of any other terms you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing. If you do not agree to these terms, you must not use our site.

They are intended to represent the entire agreement between you and us in relation to their subject matter. If you are a business customer you acknowledge that you have not relied on any statement, promise, representation, assurance or warranty not set out here. If you are a consumer and believe you have relied on something not set out here, please contact us to clarify the position.

These terms also refer to other terms that apply to you:

  • Our terms and conditions of sale, available from Q-Finance, which set out the terms of any contract for the purchase of a vehicle.
  • Our Privacy Policy, which sets out how we process personal data. By using our site you consent to that processing and warrant that the data you provide is accurate.
  • Our Cookie Policy, which explains the cookies on our site.

Information on this site

  • The content is provided for general information only. It is not advice on which you should rely, and you should obtain professional or specialist advice before acting, or refraining from acting, on it.
  • Although we make reasonable efforts to keep the site up to date, we make no representations, warranties or guarantees that its content is accurate, complete or current.
  • Descriptions and illustrations are for illustrative purposes only, give an approximate idea of the vehicles described, and form no part of any contract.
  • Any finance quotes obtained on this site are illustrative examples based on the vehicle and figures you submit. Your application will be processed by the finance company, not by us, and will take account of your personal credit rating, so the actual quote may differ.
  • Any part exchange valuations are estimates based on the information you submit. The actual valuation is agreed after the vehicle has been appraised.

Our site is only for users in the UK

Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through it is appropriate or available in other locations. Finance quotes are not applicable to persons residing outside the United Kingdom.

How you may use material on our site

We are the owner or licensee of all intellectual property rights in our site and in the material published on it. Those works are protected by copyright laws and treaties around the world, and all such rights are reserved.

You may print one copy and download extracts of any page for your personal use, and draw them to the attention of others in your organisation. You must not modify the copies in any way, or use any illustration, photograph, video or graphic separately from its accompanying text. Our status as the author of content on the site must always be acknowledged, and you must not use any part of it for commercial purposes without a licence from us.

If you print, copy or download any part of our site in breach of these terms, your right to use the site ceases immediately and you must, at our option, return or destroy any copies you have made.

Our responsibility for loss or damage

Whether you are a consumer or a business user:

  • We do not exclude or limit our liability to you where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors, and for fraud or fraudulent misrepresentation.
  • Different limitations and exclusions apply to liability arising from the supply of products to you, which are set out in our terms and conditions of sale.
  • Nothing in these terms limits or affects the exclusions and limitations in those terms and conditions of sale.
  • This section survives the termination of any contract between us.

If you are a business user only:

  • We exclude all implied conditions, warranties, representations or other terms that may apply to our site or its content, to the fullest extent permitted by law.
  • We will not be liable for any loss or damage, whether in contract, tort including negligence, breach of statutory duty or otherwise, even if foreseeable, arising from use of or inability to use our site, or reliance on any content on it.
  • In particular we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss.
  • Subject to the above, our total liability arising under or in connection with any contract between us is limited to the total amount payable by you under that contract.

Viruses and misuse

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your technology to access it, and should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other malicious material; attempt to gain unauthorised access to the site, its server or any connected database; or attack it by denial-of-service. Doing so is a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and co-operate with them by disclosing your identity, and your right to use our site will cease immediately.

Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not suggest any form of association, approval or endorsement where none exists, or link from a website you do not own. Our site must not be framed on any other site, and you may not link to any part of it other than the home page. We reserve the right to withdraw linking permission without notice.

General

  • Assignment and transfer. We may assign or transfer our rights and obligations to another entity, and will notify you in writing or by posting on this page. You may only assign or transfer yours with our written agreement.
  • Waiver. If we do not insist that you perform an obligation, do not enforce our rights, or delay in doing so, that does not waive our rights or mean you need not comply. Any waiver will be in writing and will not waive any right relating to a later default.
  • Severance. Each paragraph operates separately. If a court decides any of them is unlawful or unenforceable, the rest remain in full force.
  • Third party rights. The contract is between you and us. No other person has any right to enforce its terms.

Complaints. If a problem arises or you are dissatisfied, we have a comprehensive complaints policy — see our Complaints Procedure.

Alternative dispute resolution. If you are a consumer and are not happy with how we have handled a complaint, you may submit it to Trading Standards, whose local branch you can find via their website.

Which country's laws apply

If you are a consumer, these terms, their subject matter and their formation are governed by English law. You and we both agree that the courts of England and Wales have exclusive jurisdiction, except that if you live in Northern Ireland you may also bring proceedings there, and if you live in Scotland you may also bring proceedings in Scotland.

If you are a business, these terms, their subject matter and their formation, including any non-contractual disputes or claims, are governed by English law, and we both agree to the exclusive jurisdiction of the courts of England and Wales.
